Ghana’s Judiciary Gears Up for Galamsey Battle with Landmark Training on Land and Mining Laws

As illegal mining continues to wreak havoc on Ghana’s environment and threaten the social fabric of mining communities, a two-day judicial training session has been launched to equip Judges and Magistrates with the tools to respond decisively to land and mining-related disputes.

Organised under the auspices of the Ghana Chamber of Mines, the training brought together Circuit Court Judges and Magistrates from the Western, Central, and Western North Regions—epicentres of both legal and illegal mining activity.

The move marks a strategic shift in Ghana’s legal response to environmental and land governance crises, especially the surge in galamsey (illegal mining), by enhancing the judiciary’s capacity to interpret and enforce the Land Act, 2020 (Act 1036) and the Minerals and Mining Act, 2006 (Act 703).

Judges Take Centre Stage in Land and Resource Protection

His Lordship Justice Tanko Amadu, Supreme Court Judge and Head of the Judicial Training Institute (JTI), stressed that the training was more than academic—it was a call to action.

“This training comes at a time when the courts are under increasing pressure to resolve complex land disputes, environmental violations, and clashes between traditional landowners and mining firms. Our decisions will shape the future of Ghana’s land and natural resource governance,” he said.

He described the judiciary as custodians of legal accountability, whose rulings have far-reaching implications for investors, local communities, and the environment. He emphasized the need for consistent, constitutionally grounded interpretations of the law.

Focus on Uniformity, Sustainability, and Justice

Justice Amadu noted that the Land Act, 2020, which consolidated decades of fragmented legislation, offers a clear framework for land governance. But to realise its potential, he said, judicial officers must fully understand and apply its provisions with precision—particularly in regions where mining-related disputes are prevalent.

He also highlighted the Land Use and Spatial Planning Act, 2016 (Act 925) as critical to distinguishing lawful mining zones from protected or residential areas, noting the need for alignment between land use plans and judicial outcomes.

“We are not just resolving land disputes—we are also safeguarding the rights of communities, protecting the environment, and ensuring lawful investment,” he said.

Chamber of Mines Calls for Dedicated Illegal Mining Courts

Dr. Ken Ashigbe, CEO of the Ghana Chamber of Mines, underlined the urgency of the initiative, citing the ongoing environmental degradation and public health risks posed by illegal mining.

“Galamsey is not just an environmental issue—it is a national security crisis. The judiciary must be empowered to respond with the urgency and clarity the situation demands,” he said.

To address delays in prosecuting illegal mining cases, Dr. Ashigbe called for the establishment of specialised courts to expedite justice and restore public confidence in legal remedies.

The Chamber pledged continued support for institutions working to combat illegal mining and promote responsible resource governance.

A Turning Point for Land and Mining Justice

Beyond courtroom skills, the training aims to foster deeper awareness of the social, environmental, and economic stakes involved in land disputes, particularly in Ghana’s mineral-rich but often underserved rural communities.

Participants were reminded that land is more than property—it is a source of identity, livelihood, and community cohesion. Misjudgments or legal ambiguity can fuel conflicts and undermine trust in state institutions.

As the nation confronts the twin challenges of land degradation and mining exploitation, the judiciary’s ability to deliver timely, informed, and impartial justice will prove crucial.

This training, according to organisers, is not just a knowledge upgrade—it is a legal and moral imperative to protect Ghana’s lands, its people, and its future.
