Journalist Challenges Legality of ORAL’s Operation in Supreme Court

Veteran journalist and Editor-in-Chief of the Daily Searchlight, Kenneth Kwabena Agyei Kuranchie, has taken the bold step of challenging the constitutional basis of Operation Recover All Loot (ORAL), a high-profile government anti-corruption initiative, at Ghana’s Supreme Court.

In a writ filed on September 24, 2025, Kuranchie questions the legitimacy of ORAL’s mandate, arguing that its structure and operations violate the 1992 Constitution. The writ names the Attorney-General as the sole defendant and invokes the Supreme Court’s original jurisdiction under Article 2(1)(b) of the Constitution and Rule 45 of the Supreme Court Rules (C.I. 16).

Kuranchie’s legal action casts a shadow over ORAL, which was launched with much political fanfare and tasked with retrieving allegedly misappropriated state funds from both current and former public officials. While supporters hail ORAL as a decisive step toward ending entrenched corruption, critics have raised red flags about its legal underpinnings and potential overreach.

What Kuranchie Is Asking the Court to Declare

Kuranchie’s petition seeks multiple reliefs, including:

A declaration that all actions taken by ORAL—including investigations, reports, and prosecutions—are unconstitutional and null and void.

A halt to all ongoing prosecutions and proceedings emanating from ORAL until the Supreme Court renders its decision.

A full audit of public funds allocated to ORAL’s operations.

A surcharge against any individuals found to have inappropriately used government funds in relation to the initiative.

Kuranchie maintains that the government overstepped its constitutional boundaries by establishing an anti-corruption unit that, in his view, lacks the legal and institutional backing to function in such a prosecutorial and investigative capacity.

Wider Implications

This legal challenge comes at a time when public debate over the balance between anti-corruption enforcement and due process is intensifying. If the court sides with Kuranchie, it could have far-reaching implications not only for ORAL’s current investigations and prosecutions but for future attempts to create specialized anti-corruption task forces without parliamentary approval or constitutional grounding.

Legal observers note that the Attorney-General is expected to respond to the suit within 14 days, as required under the Supreme Court’s procedural rules. The outcome of the case could either reaffirm the government’s authority in creating such initiatives—or strike a significant blow to its anti-graft strategy.

For now, the case sets the stage for a constitutional test that may reshape how Ghana fights corruption—and how far executive powers can stretch in the process.
