CSOs Rally Behind OSP, Seek Supreme Court Input to Defend Anti-Corruption Mandate

A group of 12 civil society organisations has moved to intervene in a Supreme Court case concerning the Office of the Special Prosecutor (OSP), signalling strong support for the institution’s continued prosecutorial independence.

The coalition says it will file an amicus curiae brief—commonly known as a “friend of the court” submission—in the ongoing case involving Noah Adamtey, which is before the apex court. The intervention is aimed at defending the constitutional basis and operational scope of the OSP.

According to the group, the decision reflects increasing concern within civil society circles about efforts that could potentially weaken Ghana’s anti-corruption architecture.

At a media briefing, representatives of the coalition argued that any attempt to limit the OSP’s authority to investigate and prosecute corruption cases would undermine accountability systems, particularly in matters involving politically exposed persons.

They maintained that the OSP was created as an independent body to strengthen the fight against corruption and should retain both investigative and prosecutorial powers to remain effective.

The coalition further cautioned that restricting the institution’s mandate could erode public confidence and reverse progress made in strengthening transparency and governance reforms.

They stressed that the Supreme Court case carries significant implications for Ghana’s rule of law and anti-corruption efforts, urging that care be taken to avoid weakening existing institutional safeguards.

Speaking on the matter, the Director of Policy Advocacy and Engagement at CDD-Ghana, Kojo Asante, said the focus should be on reinforcing the OSP rather than limiting its powers.

He argued that constitutional concerns, if any, could be addressed through the constitutional review process rather than through legal curtailment of the institution’s mandate.

The coalition includes CDD-Ghana, IMANI Africa, Transparency International Ghana, the Ghana Anti-Corruption Coalition (GACC), the Africa Centre for Energy Policy (ACEP), and NORSAAC.
