POS Foundation pushes for swift implementation of Community Service Law

The POS Foundation has urged government to move quickly to develop and pass the necessary legislative instrument to give effect to the newly passed Community Service Bill, 2026, warning that the success of the reform will depend on a clear implementation framework.

The Foundation, which has been a key advocate for alternative sentencing reforms in Ghana, said the passage of the Bill by Parliament on July 10, 2026, marked a significant step towards transforming the country’s criminal justice system.

In a statement signed by its Founder and Executive Director, Mr Jonathan Osei Owusu, the organisation called for urgent action to operationalise the law and ensure its effective application across the country.

“While celebrating this important milestone, POS Foundation calls for the urgent development and passage of the necessary legislative instrument to operationalise the law and ensure effective implementation nationwide,” the statement said.

The Community Service Bill introduces community service orders as an alternative to imprisonment for eligible persons convicted of certain offences, particularly those punishable by less than three years’ imprisonment.

The law provides a framework for the supervision, monitoring and enforcement of community service orders, while requiring collaboration among the Ministry of Justice, the Judicial Service, local authorities and civil society organisations.

POS Foundation said the new law had the potential to ease pressure on Ghana’s prisons, support the rehabilitation of offenders and reduce the financial burden associated with incarceration.

The organisation explained that community service would allow low-risk offenders to remain connected to society while contributing positively to their communities, rather than being exposed to prison environments that could increase the likelihood of reoffending.

The Foundation, however, cautioned that the success of the initiative would depend on public acceptance and a shift away from stigmatising persons who serve community sentences.

It encouraged communities to embrace restorative justice by supporting rehabilitation efforts and giving offenders opportunities to reform and reintegrate.

“Successful reintegration depends not only on sound legislation but also on communities willing to offer second chances, encourage accountability, and foster positive behavioural change,” the statement noted.

POS Foundation commended government, Parliament and stakeholders for supporting the passage of what it described as a landmark reform in Ghana’s criminal justice system.

The organisation noted that it had contributed significantly to the development of the Community Service Bill, including engagements with the Judiciary and the Open Society Initiative for West Africa (OSIWA) during the review process.

It also highlighted its role in implementing the Justice for All Programme, which has contributed to reducing Ghana’s remand prison population from 33 per cent in 2007 to 12.8 per cent, according to Ghana Prison Service records.

The Foundation expressed optimism that the implementation of the Community Service Law would strengthen restorative justice, promote safer communities and create a fairer criminal justice system.
