The High Court in Sogakope has ordered the release of a Nissan pickup belonging to the Akatsi South Municipal Assembly, bringing an end to its seizure following a judgment execution that was later set aside.
The decision followed an application by the Assembly, supported by the Office of the Attorney-General, which argued that the vehicle was a state asset and therefore not subject to attachment in settlement of a private judgment debt.
The Nissan pickup, with registration number GN 8864-18, had been seized in enforcement of a court judgment against the Assembly. However, the court was informed that the vehicle was procured by the Government of Ghana through the Ministry of Local Government and Rural Development and assigned to the Assembly strictly for official duties.
Court filings indicated that the vehicle forms part of government property used to support statutory functions such as project supervision, revenue mobilisation, monitoring, and the implementation of development programmes.
In its ruling, the High Court held that public assets assigned to state institutions for official work are generally protected from execution where their seizure would interfere with essential public service delivery.
The court further emphasised the need to balance enforcement of judgment debts with public interest considerations, particularly in situations where local government operations could be disrupted.
The Attorney-General’s Department maintained that the seizure of the vehicle was improper, arguing that its continued detention was affecting the Assembly’s ability to effectively discharge its mandate.
The court subsequently granted the application on June 24, 2026, and directed the immediate release of the vehicle to the Assembly after setting aside the earlier execution.
The ruling has been welcomed by officials of the Assembly and some residents, who say it reinforces the protection of public assets and ensures continuity in local governance functions.
Municipal Chief Executive, Daniel Dagba, said the recovery of the vehicle would improve the Assembly’s operational efficiency, particularly in monitoring projects and delivering services across the municipality.
Assembly officials also expressed hope that the decision would serve as guidance in preventing similar disputes involving public property in future enforcement actions.
