The Minority in Parliament has maintained that the Office of the Special Prosecutor still has full legal authority to carry out its duties despite a recent High Court ruling affecting its prosecutorial powers.
Speaking to journalists, Hassan Tampuli argued that only the Supreme Court of Ghana has the constitutional authority to determine whether an Act of Parliament is invalid.
According to him, the High Court cannot suspend or nullify the law that established the OSP through any legal process.
He stressed that the legislation establishing the OSP, Act 959, remains in force and continues to provide the institution with its mandate.
Mr Tampuli said the recent High Court ruling directing the Attorney-General’s Department to take over criminal prosecutions being handled by the OSP does not override the law establishing the anti-corruption body.
He insisted that until the Supreme Court delivers a final ruling, the OSP remains legally empowered to operate and pursue its mandate.
