Judicial Nomination in Limbo as Petition Halts Vetting of Justice Kweku T. Ackaah-Boafo

The vetting process for Justice Kweku T. Ackaah-Boafo’s appointment to the Supreme Court has been unexpectedly stalled after a petition alleging judicial misconduct was submitted just before his scheduled hearing in Parliament’s Appointments Committee.

The committee’s indefinite postponement marks a rare disruption in the usually smooth vetting of President John Mahama’s nominees, placing Justice Ackaah-Boafo’s elevation in uncertain territory. The Supreme Court, Ghana’s apex judicial body, relies on such appointments to maintain its full bench and effectively manage cases across panels of several judges.

The petition, presented by human rights activist Anthony Kwabenya Rau, accuses the nominee of bias, inappropriate courtroom conduct, and personal attacks during a prior case at the Driver and Vehicle Licensing Agency (DVLA) courts. Mr. Rau claims that Justice Ackaah-Boafo’s written judgement contained derogatory remarks and questions his right to represent clients, describing the judge as “arrogant” and “power-drunk.”

Moreover, the petition raises cultural concerns, questioning Justice Ackaah-Boafo’s Canadian ties and respect for Ghanaian customs, particularly citing an incident involving the petitioner’s age.

Additional allegations suggest the judge refused interest payments linked to a political case before his promotion to the Court of Appeal, hinting at political entanglements.

The Appointments Committee has forwarded the petition to Speaker Alban Bagbin, who will decide how to proceed, emphasizing the seriousness with which such complaints are handled. Parliamentary procedures require these petitions to be investigated within 30 days to determine their validity and ensure the vetting process remains fair and transparent.

Supporters of Justice Ackaah-Boafo have dismissed the accusations as unfounded, affirming his professionalism and readiness to resume vetting once the matter is resolved.

This incident highlights the complex challenge Ghana faces in balancing the need for judicial independence with demands for accountability during high-profile judicial appointments. The Speaker’s forthcoming decision is anticipated not only to impact this nomination but could influence future vetting practices and the integrity of Ghana’s judicial system.

As the nation watches closely, the outcome will signal how Ghana navigates potential controversies surrounding judicial appointments in its evolving democratic framework.
