Gov’t to Introduce Anti-Misinformation Bill Amid Pledge to Protect Free Speech

As Ghana’s digital space continues to expand and influence public discourse, the government is stepping up efforts to combat the growing threat of misinformation—without compromising constitutional freedoms.

Minister for Communication, Digital Technology and Innovation, Sam George, has announced that a comprehensive legislative framework to tackle online misinformation and disinformation is almost complete and will be laid before Parliament in its next session.

Dubbed the National Misinformation and Disinformation Bill, the proposed law is part of the government’s broader digital governance strategy aimed at promoting accountability and truthfulness in Ghana’s fast-evolving information ecosystem.

Balancing Digital Responsibility and Free Speech

Speaking at a press briefing on Thursday, July 3, Minister George stressed that the bill is not designed to silence dissent but rather to curb the deliberate fabrication and spread of harmful digital content.

“We’re not here to police opinions. What we are addressing is the deliberate manufacture and viral spread of falsehoods that threaten public safety, national security, and democratic stability,” he stated.

He underscored the bill’s dual commitment: enforcing digital responsibility while preserving citizens’ freedom of expression as guaranteed by the 1992 Constitution.

“Freedom of expression is sacrosanct, but when it is weaponized to spread misinformation, especially in critical times like elections or emergencies, there must be a legal recourse,” he added. “Your right to free speech ends where your duty not to mislead begins.”

What the Bill Proposes

The draft legislation aims to:

  • Establish clear definitions for misinformation and disinformation;

  • Empower designated regulatory bodies to investigate and prosecute violations;

  • Introduce penalties for willful publication of harmful falsehoods;

  • Promote digital literacy and fact-checking initiatives; and

  • Provide safe harbor protections for responsible journalism and free speech.

The Ministry says the bill also draws on global best practices from countries like Finland, Australia, and South Africa, balancing enforcement with safeguards against government overreach.

Public Trust in a Digital Age

With growing concerns over fake news, deepfakes, and viral hoaxes affecting public trust and civic engagement, especially on platforms like WhatsApp, TikTok, and Facebook, the Ministry sees the bill as a necessary tool to build resilience against digital manipulation.

“We want to ensure that our digital environment supports informed decision-making, not confusion and chaos,” Minister George noted.

Civil Society and Media Stakeholders to Be Consulted

The Ministry indicated that it will soon begin stakeholder consultations with media houses, civil society organisations, academia, and digital rights groups to refine the bill before parliamentary debate.

While some digital rights advocates are cautiously optimistic, others have called for strong oversight mechanisms to prevent abuse of the law against political opponents or critical voices.

As Ghana heads into an increasingly digital future, the upcoming bill is expected to set the tone for how the nation balances truth, freedom, and accountability in cyberspace.
