Why I jailed Atta Ayi 70-Years – Justice Baffoe-Bonnie Defends Decision

Chief Justice nominee Justice Paul Baffoe-Bonnie has justified his famous decision to hand a 70-year jail term to notorious armed robber Ataa Ayi, describing it as an act of judicial responsibility aimed at protecting the public from a dangerous criminal.

Appearing before Parliament’s Appointments Committee on Monday, November 10, 2025, Justice Baffoe-Bonnie revisited one of the most talked-about cases of his judicial career, using it to illustrate the delicate balance between judicial discretion, sentencing guidelines, and the duty of judges to safeguard the public.

According to him, while judges are guided by sentencing frameworks, “the realities of certain crimes” sometimes compel the court to impose harsher penalties in the interest of justice and deterrence.

“Judges and magistrates are trained to follow sentencing guidelines,” he said. “But sometimes, you have to go beyond them. In my youthful days, I gave someone 70 years—Ataa Ayi—because of the nature of his crimes and the risk he posed to society.”

Justice Baffoe-Bonnie said his decision at the time was grounded not just in law but in a sense of duty to ensure the safety of citizens, noting that Ataa Ayi’s reign of terror had instilled widespread fear across Accra and beyond.

“I told myself that if I gave him 30 years and he came back, he might come after me or my family. So, by the time he returns after 70 years, I’ll be long gone,” he remarked humorously, drawing laughter from committee members.

The nominee emphasized that sentencing is not merely about punishment but about justice, deterrence, and public protection — a complex judicial exercise that requires both legal knowledge and moral judgment.

A Symbol of Judicial Firmness

Justice Baffoe-Bonnie’s 70-year sentence for Ataa Ayi, delivered in 2005, became a defining moment in Ghana’s criminal justice history, symbolizing judicial firmness in the face of rampant violent crime.

At the time, Ataa Ayi, born Ayi Ayeetey, led one of the most feared armed robbery syndicates in Ghana, notorious for robbing motorists, businesses, and households at gunpoint in the late 1990s and early 2000s.

His arrest following a nationwide manhunt, aided by police billboards displaying his image, marked a major victory for law enforcement and the judiciary.

Convicted on multiple counts of armed robbery, Ataa Ayi’s sentence was widely hailed as a deterrent measure and a statement of zero tolerance for violent crime.

Broader Judicial Reflection

Justice Baffoe-Bonnie’s comments during the vetting have reignited discussions about judicial discretion in sentencing and the evolving philosophy of justice in Ghana.

He underscored that judges must always weigh the human element in every case while upholding the rule of law.

“Justice must serve both the offender and the society,” he said. “Sometimes, that means making very tough decisions.”
