Minority Questions Judicial Transparency as Kpandai Election Ruling Stalls Without Written Judgment

The Minority in Parliament is raising fresh concerns over judicial transparency and due process following the continued delay by the Tamale High Court to release its written judgment in the Kpandai parliamentary election case.

In a statement issued on Monday, December 1, 2025, Minority Leader Alexander Afenyo-Markin said the situation has created a legal vacuum, leaving all parties unable to proceed with necessary actions — including an appeal, an application for a stay of execution, and administrative steps by the Electoral Commission.

Justice Emmanuel Bart Plange Brew annulled the 2024 Kpandai parliamentary results last week and ordered a rerun within 30 days. However, despite announcing in open court that a full written judgment would be delivered on Friday, November 28, the judge has yet to provide the document or respond to two formal requests submitted by lawyers representing MP Mathew Nyindam.

The Minority argues that the absence of the written decision is now impeding the constitutional right to appeal.

“This delay is no longer procedural. It completely freezes the appellate process in a matter affecting parliamentary representation,” Afenyo-Markin said.

Questions have also been raised about the scope of the annulment, as the court cancelled all 152 polling stations in the constituency even though the petition before it challenged only 41.

According to the Minority, the failure to release the ruling now prevents public scrutiny of the legal grounds for such a sweeping decision — one that effectively strips a sitting Member of Parliament of his mandate.

The group is therefore urging Justice Plange Brew to urgently publish the full judgment to restore confidence in the judicial process and allow the appeal to proceed.

Nyindam has already filed a notice of appeal and a stay of execution, but neither application can be advanced until the written judgment is released.
