Court Upholds Special Prosecutor’s Authority in Ofori-Atta Arrest Warrant Case

The High Court has handed a significant victory to the Office of the Special Prosecutor (OSP), dismissing a legal challenge by former Finance Minister Ken Ofori-Atta that sought to nullify an arrest warrant issued against him.

In a ruling that reaffirms the powers of Ghana’s foremost anti-corruption agency, the court on Thursday rejected Mr. Ofori-Atta’s application in full, ruling that the OSP acted within the bounds of its legal mandate.

The former minister, currently outside the country, had filed the motion seeking to invalidate the warrant and halt all enforcement processes, including a request for an Interpol Red Notice.

His lawyers contended that the Special Prosecutor had overstepped procedural and jurisdictional limits in seeking the warrant. But the court disagreed.

> “The application lacks merit and is accordingly dismissed,” the presiding judge ruled, bolstering the OSP’s controversial but determined push to hold high-ranking officials accountable.

The ruling marks a critical juncture in the growing standoff between Mr. Ofori-Atta and the OSP, which has been investigating him over alleged procurement breaches and financial mismanagement during his tenure at the Finance Ministry.

The former minister has declined to appear before the OSP, citing medical treatment overseas—a reason the OSP has publicly questioned. His absence prompted the agency to declare him wanted in June, initiating steps to engage Interpol in tracking his whereabouts.

Legal analysts say the court’s decision sends a strong message that the judiciary is prepared to support institutional efforts to combat corruption—especially where due process is followed.

> “It reinforces the OSP’s credibility and signals that no one is above the law,” said constitutional lawyer Irene Asamoah. “Even politically exposed persons can be held to account when the system works.”

While Mr. Ofori-Atta maintains his innocence, the ruling now opens the door for renewed local and international enforcement of the arrest warrant.

Observers believe the decision could embolden the OSP to pursue further high-profile investigations, many of which have been met with stiff resistance or political pushback.

The OSP has yet to issue an official statement following the court victory, but sources close to the office describe the ruling as a legal and moral boost for its operations.

Mr. Ofori-Atta’s legal team is reportedly considering its next steps, which may include an appeal.
