Supreme Court Grants Akwatia MP Hearing in Contempt Conviction Appeal

The Supreme Court has ruled, in a 4-1 decision, that Ernest Yaw Kumi, the Member of Parliament for Akwatia, will be granted a hearing despite his conviction for contempt of court. The decision, delivered by a five-member panel, comes as the MP seeks to challenge his conviction by the Koforidua High Court.

The apex court stated that it will provide detailed reasons for its ruling by March 21, 2025, while setting March 26, 2025, as the date to hear the MP’s application for certiorari and prohibition.

The case revolves around the legal question of whether the Supreme Court can entertain an appeal from an individual convicted of contempt without first requiring the person to purge themselves of the offense.

Mr. Gary Nimako Marfo, counsel for the MP, argued that his client was denied a fair hearing at the High Court level. He explained that the trial judge, Justice Emmanuel Senyo Amedahe, disregarded key legal processes, including a pending application for a stay of proceedings and a request for his recusal.

According to Mr. Marfo, the High Court’s decision to proceed under these circumstances raises concerns about the fairness of the conviction, making it necessary for the Supreme Court to intervene.

“The Supreme Court ought not to shut its doors of justice on the applicant,” he stated, emphasizing that his client has consistently challenged the jurisdiction of the Koforidua High Court in this matter.

Meanwhile, Mr. Bernard Bediako Baidoo, counsel for the first interested party, Nana Boakye Yiadom, refrained from making legal arguments and instead left the decision to the discretion of the Supreme Court.

The contempt charge against Mr. Kumi stems from his alleged defiance of a court injunction, after which he proceeded to be sworn into Parliament as the MP for Akwatia. His legal team is now asking the Supreme Court to quash the conviction.

Under Ghanaian law, individuals convicted of contempt are generally required to purge themselves before seeking relief from a higher court. However, legal exceptions exist, which the Supreme Court is expected to consider in this case.

With the matter now before the highest court, the ruling could have significant implications for how contempt convictions are handled, particularly in politically sensitive cases.
