In a significant step towards strengthening dispute resolution frameworks in Africa, the Community Court of Justice of ECOWAS and the African Union’s Dispute Settlement Mechanism (DSM) convened a high-level benchmarking meeting in Abuja, Nigeria, to explore institutional cooperation and knowledge exchange focused on arbitration.
The meeting served as a crucial platform for the two bodies to discuss collaborative opportunities, including joint capacity-building programs, shared expertise, and streamlined case referral processes. Both institutions aim to harness their combined strengths to enhance peaceful and efficient resolution of disputes across the continent.
Central to the discussions was the ECOWAS Court’s mandate to act as arbitrator pending the formal establishment of the Arbitration Tribunal, as outlined in Article 9(5) of its Protocol. The Court showcased its innovative Electronic Case Management System (ECMS), which modernizes judicial processes, improves accessibility, and cuts costs for users.
On the other hand, the AU’s DSM, established under the 1999 Yamoussoukro Decision to regulate Africa’s air transport market, highlighted its broad scope in conciliation, mediation, and arbitration for resolving sector-specific disputes.
The meeting also laid groundwork for a potential Memorandum of Understanding to formalize cooperation, signaling a forward-looking approach to enhancing alternative dispute resolution mechanisms.
Both parties expressed a strong commitment to institutional synergy, underscoring their shared vision of fostering legal certainty and harmony within ECOWAS member states and beyond.
This collaboration marks a promising milestone in Africa’s judicial landscape, leveraging innovation and partnership to advance sustainable dispute resolution.
