Lead counsel for the first accused in the ongoing National Food Buffer Stock Company (NAFCO) criminal trial, Godfred Yeboah Dame, has announced plans to challenge a High Court ruling that requires the prosecution to amend two counts on the charge sheet.
The decision concerns Counts 9 and 14, both of which accuse the defendants of defrauding by false pretences.
The High Court, presided over by Justice Francis Achibonga, held that the two counts did not contain sufficient particulars to clearly inform the accused persons of the specific allegations they are required to answer.
The court consequently directed the Attorney-General to amend the charges by providing further details before the trial proceeds on those counts.
However, Mr Dame has disagreed with the decision and indicated that he will appeal against the ruling at the Court of Appeal.
The proposed appeal introduces a new legal challenge in the case, even as the prosecution prepares to amend the two disputed counts in accordance with the High Court’s order.
The accused persons, former NAFCO Chief Executive Officer Hanan Abdul-Wahab Aludiba and his wife, Faiza Seidu Wuni, are facing 20 charges, including stealing and causing financial loss to the State.
The case has been adjourned to July 29, 2026.
