High Court Dismisses Dual Citizenship Charges Against Gyakye Quayson

In a landmark ruling on Wednesday, April 9, 2025, the High Court acquitted and discharged James Gyakye Quayson, the Member of Parliament for Assin North, marking a significant legal and political victory after years of intense scrutiny and litigation.

Rather than opting for a political settlement, Quayson boldly chose to face the full weight of the legal process—turning down an offer from Attorney General and Minister for Justice, Dr. Dominic Ayine, to have the charges dropped. His insistence on going to trial, he said, was rooted in a desire to clear his name and protect his integrity in the eyes of his constituents and the Ghanaian public.

“I needed this case to be decided in court, not in secret or behind closed doors. I have nothing to hide,” Quayson remarked shortly after the ruling.

The court’s decision followed a submission of no case to answer filed by his legal team. In a detailed judgment, the court found that the prosecution had failed to substantiate any of the five charges brought against him, which included allegations of forgery, perjury, and false declarations.

Central to the case was the claim that Quayson had failed to renounce his Canadian citizenship before contesting the 2020 parliamentary elections. However, the court ruled that the evidence proved otherwise.

It found that by the time he filed his nomination, Quayson had already initiated the renunciation process, demonstrating his intent and good faith. The judge emphasized that there was no proof of dishonest intent or false declarations on Quayson’s part.

The court also flagged inconsistencies in the testimony and documentation provided by prosecution witnesses, particularly pointing to discrepancies in the passport summary sheets and statutory declarations—further weakening the case against the MP.

With the dismissal of the charges, Quayson can now serve his constituents without legal hindrance, bringing to a close one of the most closely-watched legal battles in recent Ghanaian political history. For his supporters, the ruling is not just a legal victory but a vindication of their belief in his integrity and resilience.

This verdict also raises broader questions about the use of criminal charges in political disputes, and whether the justice system is being weaponized against elected officials. For now, however, James Gyakye Quayson walks free—his reputation intact, and his mandate reaffirmed.
