The legal team representing former National Signals Bureau Director-General, Kwabena Adu Boahen, has accused state prosecutors of concealing vital evidence that could exonerate their client in the ongoing GHS49 million misappropriation case.
Lead counsel Samuel Atta Akyea made the claim after the High Court in Accra dismissed his objection to the Attorney General’s withdrawal of charges against Mildred Donkor, the third accused, who has now been discharged to testify for the prosecution.
Speaking on Citi Eyewitness News on Friday, October 17, Atta Akyea alleged that the prosecution’s decision to withhold certain documents and disclosures was undermining the fairness of the trial.
“We are fortified that our client is very innocent, but we will fight on. What they are trying to hide is what will set us free,” Atta Akyea stated.
He added that his team would explore other legal options to compel the release of the evidence, describing it as “the weapons of our warfare.”
The court, presided over by Justice John Nyadu Nyante, ruled that the Attorney General, Dr. Dominic Ayine, acted within his powers under Section 59 of the Criminal and Other Offences (Procedure) Act, 1960 (Act 30) in discontinuing the case against Donkor.
Adu Boahen, together with his wife Angela Adjei-Boateng and their company Advantage Solutions Limited, is standing trial over alleged theft and misappropriation of GHS49 million in state funds.
Atta Akyea’s legal team had argued that the Attorney General’s withdrawal should have been made by a formal motion, given the significant change in the case’s direction. The court, however, disagreed, holding that the Attorney General has broad constitutional authority to decide how to conduct prosecutions.
Despite the ruling, Atta Akyea insists the defence will not relent until full disclosure is achieved, emphasizing that the credibility of the justice system depends on transparency and adherence to due process.
The case is expected to continue in the coming weeks, with Mildred Donkor set to take the stand as a prosecution witness in what could prove to be a pivotal turn in the high-profile trial.
